You agree to these terms and conditions.

Order terms: By ordering from CanadaRAM you agree to these terms and conditions Returns and Cancellations: Compatibility of these goods with other hardware or software is not guaranteed, and is the customer’s responsibility to verify prior to purchase. Please refer to the product manufacturer’s website for specifciation information, compatibility and features before ordering. Returns of non-defective goods are only by CanadaRAM Ltd. pre-approval and at the discretion of CanadaRAM, and only if goods are unopened and in saleable condition. Customer bears shipping costs, a restocking charge of 15% ~ 20% of the total with a minimum restocking of $15.00 will apply to cover our costs (updated price of goods may apply, at the discretion of CanadaRAM). Our labour, shipping and handling are not refundable. Cancellations of orders prior to stock being shipped, which were paid by Paypal or Credit card will be refunded to the same payment method, less a 3.5% charge (minimum charge $10) to cover the PayPal/Credit card charges which we can’t get back. Cancellations received after product has shipped to us from the supplier will be charged a restocking charge as above. Warranty replacement only (no return for refund) on Kingston memory, CPUs, Flash media, motherboards, video cards, opened or formatted drives, recording media, personal use items (such as earphones), software or special order goods. Returned goods with damage (including damage done during installation, burned or damaged memory contact pins, tool marks, or freight damage from inadquate customer packaging) or goods that are incomplete will not be accepted for refund or warranty and will be charged at full price. Please email sales@aupgrades.com with any warranty or return questions before returning products. You will be given instructions specific to the product and authorization to return. Do not ship any goods before you have received a Returned Materials Authorization (RMA) and instructions where to send.

For your protection: The charge card billing address, name and phone number must be provided, for your protection we may also ask for additional ID and/or a photocopy of the card and signature to be faxedThe credit card issuing bank must be able to verify the billing address, name and CVD code. If not, order may be delayed. Orders where bank confirmation or requested ID are not forthcoming will be cancelled. Street address, phone number and postal code for delivery must be provided with orders. We require written confirmation from the cardholder if product is being shipped to a third-party address; email to sales@aupgrades.com . Why do we ask for confirmation? To protect you. If you were purchasing in person we could verify your signature, your ID, and that you were in posession of the actual charge card. Without verification, anybody (your pizza delivery person for example) who had your card number and address could fraudulently charge purchases to your card, so the banks ask us to take these extra steps to verify the charge is legitimate.

Payment:

Payment is accepted by VISA, Mastercard, PayPal, American Express (through PayPal) or Interac Email transfer from a Canadian bank to sales@aupgrades.com. Non-certified cheques will take 2 to 3 weeks to clear before order is sent. Orders are accepted at the sole discretion of CanadaRAM Ltd. Submission of an orderform and/or payment does not constitute a contract to supply goods. Availability and price of goods are liable to change without notice. Appropriate taxes and shipping will be added to your order if left blank on the form.

Paypal:

PayPal payment to sales@aupgrades.com is accepted, PayPal orders can ONLY BE SHIPPED TO THE CONFIRMED PAYPAL ACCOUNT HOLDER’S ADDRESS. eCheque orders will take 7 – 10 days before PayPal releases the funds. Your PayPal emails will show payment to sales@aupgrades.com. American Express can be accepted through PayPal.

Prices:

Prices are in Canadian Dollars, and are subject to change without notice. please Email to confirm price before ordering. GST is extra in Canada, PST is extra in BC, HST is extra in Ontario, NB, NS, NF and PEI. Appropriate taxes and shipping will be added to your order if left blank on the order form.

CanadaRAM.com Shopping Cart

When you first create your shopping cart account, the address to use is the billing address of the charge card. The name and address of the account must match the name and address that the bank has on file for that charge card. If your shipping address is different, you can enter it later in the order. It is the customers responsibility to maintain up to date address information in the shopping cart.

For special orders, volume purchases, PayPal, Interac or cheque payment, special shipping arrrangements and items that don’t have pricing on the website or ADD buttons, please email us or fill out our manual order form

Shipping:

Please ADD your products to the shopping cart in order to view shipping price estimates based on your location and items purchased. You must enter the address (including door access or intercom buzz code if in a multiunit building) and postal code accurately, or additional courier fees may apply. Extra courier redirect or return charges will apply on orders with incomplete or incorrect addresses. Shipping charges are not refundable.

Special orders may take longer. FedEx and Purolator packages and insured packages over a certain value may require an adult signature on delivery.

Delivery Shipping time estimates are estimates only. We do not guarantee arrival dates or times, delivery is dependent on courier performance. Fedex Overnight is 1 – 2 business day service to most major centres in Canada, only for in-stock orders received before the processing deadline. Delivery is Monday to Friday excluding holidays, no outgoing shipping or delivery on weekends. Shipping time and cost may be higher in NU, NT, YK and remote areas. Tracking

Packages are trackable up to the point they have been scanned at the door for delivery. Couriers do not ask for ID on delivery or verify that the delivery address given matches the customer name. The package is considered delivered when either

1) it has been scanned as delivered by the courier or

2) in the case of signature required delivery has been signed for by any adult at the address or at the postal counter, or

3) in the case of the Canada Post Parcel Free Shipping option, when CanadaRAM delivers the parcel to Canada Post.

CanadaRAM assumes no responsibility for misdelivery due to errors in the address provided by the buyer nor for courier performance. Return to sender because of customer refusal or inaccuracy in the customer supplied address will be charged a return shipping fee equal to the amount that the carrier charges us for the return or address correction. The invoice information in the package, possibly including personal address and payment information, is potentially viewable by unknown parties if the package is stolen while in transit or misdirected. Signature is required for PayPal and Amazon orders, FedEx and Purolator deliveries. For Canada Post packages, if a signature is not available at time of delivery, you will receive a card and can pick the package up the next day at your local postal depot. Refused parcels and abandoned parcels will be refunded only after return to CanadaRAM in good order, less a restocking charge and CanadaPost/Courier return shipping charges.

Shipping Insurance: Shipping is at the buyer’s risk, liability is limited by the common carrier’s coverage of $100 per shipment, CanadaRAM Ltd. will not refund an uninsured purchase in the case of loss or damage while in transit. Receipts will be sent by email. No PO Boxes for Purolator or FedEx shipments, PO Boxes are OK for Xpress Post and Expedited Post packages.

Contract to sell:

Submission of order form does not constitute a contract to supply goods – acceptance of orders is at the sole discretion of CanadaRAM Ltd. No credit terms are offered.

Gov’t, Educational and Institutional:

Purchase orders may be accepted on prior approval of account application only, complete, scan and emil the credit application form , or your standard form credit application, to sales@aupgrades.com. Credit may be granted at the sole discretion of Canadaram. Paypal and Charge card payments are not accepted for settlement of credit term accounts. Volume discount and cash discount pricing incorporates a discount based on payment by cheque, cash, Interac transfer or debit card, payment by Paypal or charge card may not qualify for the cash/cheque/volume discount.

Warranty:

All products sold by CanadaRAM.com are covered by manufacturer’s warranty, are factory genuine and CanadaRAM Ltd. is an authorized reseller.

Warranties are covered by the manufacturer, not CanadaRAM. Manufacturers’ warranty detail:

For products other than RAM modules 1 year is the typical warranty, however warranty terms and conditions vary by manufacturer and product. Warranties cover defects of the original materials and workmanship, warranties do not cover compatibility, installation issues, software installation, user damage including burnt or damaged contact pins or tool marks or data loss or recovery.

We recommend that you back up your data in full before installing any hardware or software. If you are not confident installing hardware or software, please consult with a qualified technician. You can find instructions in your owners manual or on your computer manufacturer’s website, or on a Google web search. Please email sales@aupgrades.com with any warranty or return questions before returning products.

You will be given instructions specific to the product and authorization to return. Warranty replacement procedures may require some diagnostic or testing steps, the customer agrees to carry out reasonable testing to identify whether products are in fact defective. If the buyer does not co-operate in testing, a service fee may be assessed for testing of the products once they are returned. In most cases, warranty is handled directly by the manufacturer of the product and you will exchange products with their service centre. Do not ship any goods before you have received a Returned Materials Authorization (RMA) and instructions where to send.

Non-defective (customer discretionary) returns are subject to reasonable restocking charges and shipping is not refundable. See Terms

Other than our 10 day RAM memory DOA policy (below) Warranty shipping costs are the responsibility of the customer. Un-authorized packages and freight-collect packages will be refused.

  • Consult your computer owner’s manual for installation instructions.
  • Turn off power and unplug machine before installation.
  • Do not use tools such as pliers on RAM modules, it will damage them irrepairably.
  • Do not force a module into a socket.
  • Do not apply power to an incompletely or incorrectly installed memory module.

Warranty coverage excludes any damage done by customer. All warranties are voided by modification to or abuse of the product, damage or alteration of the product or removal of labels. Returned goods with any damage including but not limited to

  • burned or chipped contact pins from improper installation,
  • dropped hard drives,
  • tool marks,
  • damaged labels or serial numbers,
  • water damage,
  • freight damage from inadquate customer packaging

will not be accepted for refund or warranty.

Warranty terms are for replacement by new or recertified equivalent product, at the manufacturer’s discretion not for refund or credit. Customer must return the item first, to the service depot indicated by the return authorization.

In some cases, at Canadaram’s sole discretion, we may do an advance exchange where replacements are sent before the defective is returned. In the case of an advance exchange, if the returned parts are not received in good order at CanadaRAM within 15 days, the customer agrees to pay the full price for the replacement memory.

CanadaRAM policies:

  • Lifetime warranty on RAM modules: Most DDR3 and DDR4 RAM modules have a manufacturer’s limited lifetime warranty (see terms below) Older and discontinued types may have 30 days to 1 year warranty. We only sell genuine, manufacturer authorized products.
  • No-Risk Upgrade: You may return generic RAM within 10 days for a full credit towards an upgrade to Kingston branded RAM where available. Email us first for authorization.
  • Compatibility Guarantee: If we quote Kingston or Certified RAM by email for a particular computer and we make an error, we will pay all shipping on replacement in the first 10 days (Canadian orders only, replacement shipping is by Expedited Post 3 – 8 day delivery, customer may elect to upgrade shipping for an extra charge, special order products and non-RAM products excluded).
  • DOA Replacement Guarantee: A very small percentage of RAM is defective on arrival – we pay for shipping on warranty replacement in the first 10 days (Canadian orders only, replacement shipping is by Expedited Post 3 – 8 day delivery, customer may elect to upgrade shipping for an extra charge, special order products and non-RAM products are excluded).
  • Non-Defective returns: Sometimes circumstances require you to return a product without using it. Email us first to discuss, and we will likely be able to take the product back if it is new, unopened and in saleable condition with all accessories and retail packaging. Depending on the product, a restocking charge may be payable to cover our costs. Labour, Shipping and handling charges and credit card/bank charges are not refundable. There are no returns for refund on Kingston memory, CPUs, Motherboards, Software, drives which have been used (formatted) or any special-order products.

Definition of Manufacturer’s Lifetime Warranty: Manufacturer’s Lifetime Warranty is limited to the lifetime of the part in manufacturing. When a part has been discontinued by the manufacturer, and remaining replacement stocks have been depleted, repair or replacement cannot be made and the lifetime of that part is ended, consequently the warranty for that part is ended.

Goods are subject to the terms of the manufacturer’s warranty. The address of the manufacturer’s authorized return depot for warranty will vary by product. Shipping is the customer’s responsibility. CanadaRAM does not provide over-the-counter exchange on manufacturer’s warranty claims. There are no other warranties express or implied, and in no case will CanadaRAM be liable for refund or replacement of goods outside of the manufacturer’s warranty terms or in case of manufacturer non-fulfillment of their warranty.

Notice: Some types of RAM, including but not limited to the list below, have ended their life in manufacturing and the warranty period is ending. Warranty will be assessed on a case by case basis depending on the manufacturer’s ability to supply replacement parts. If the manufacturer is unable to supply replacement parts, the warranty will be expired.

  • Some models of DDR1 and DDR2 memory are at end of production, and warranty may be limited to 30 days to 1 year depending on product

Installation and compatibility: Goods are sold under the assumption that you have experience installing hardware/software in your particular machine. Please refer to your owner’s manual or manufacturer’s Web site for instructions. Accessory parts, screws, tools or cables are not included unless specified, inquire first before ordering. If you are not confident, please take your machine to a qualified technician for installation. Confirm your model required and compatibility before ordering. The customer is responsible for the safekeeping of their data. We strongly recommend making a full backup of your data before starting installation, and maintining regularly scheduled, up todate and verified backups at all times. Accuracy: Every effort has been made to ensure accuracy however the information on this website is not intended to be a guarantee of compatibility and may be subject to unintended errors, changes or revision without notice. You may have specific legal rights which may vary depending on local law. Consulting Support and Service terms – for support and service customers The Consultant will use its best efforts to resolve customers technical problems in a professional, reasonable and timely manner, taking into consideration the circumstances and nature of the technical problems and best practices of the industry. Response times may be delayed due to research and inquiries, as may be necessary. The Consultant does not assure that every request for technical support will be resolved. The Consultant consultations constitute only advice and suggestions. Technical problems may be a result of software or hardware failure, corruption or user error and may not be correctable. The Consultant reserves the right to refrain from providing any or all services ordered and refund the Client’s payment, wholly or in part, if minimum system requirements are not met or if technical conditions or customer requirements are unusual, extensive, or beyond the scope of this service agreement as reasonably determined by The Consultant. THE CLIENT’S RESPONSIBILITY You understand and agree that prior to contacting or allowing the Consultant to perform diagnostic repair or other services on the Client’s computer, it is the Client’s responsibility to back-up the data, software, information or other files stored on the Client’s computer disks and/or drives. You acknowledge and agree that The Consultant shall not be responsible under any circumstance for any loss or corruption of data and/or software. You agree to pay fees in accordance with The Consultant’s rates and policies. LIMITATION OF REMEDY The Consultant will not be held responsible for any problems arising from third party software installed on the Client’s computer by our technicians, you, or other third party. The Consultant will not be held liable for lost data due to hardware failure, virus, spyware, corruption or any other situation. If any problems with third party software or hardware arise, it is the Client’s responsibly to obtain support from the manufacturer of the product at fault or contract with the Consultant to do so on the Client’s behalf, chargeable at the hourly rate. Under no circumstances shall The Consultant be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by The Consultant or out of the installation, de-installation, use of, or inability to use the Client’s computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder. The Consultant shall not be liable for any failure or delay in performance due to any cause beyond its control. If The Consultant’s ability to render services is impaired by the Client’s failure to cooperate or circumstances beyond the control of The Consultant, The Consultant may choose not to provide services. LIMITATION OF LIABILITY & RELEASE By signing our form, you will agree to release and hold harmless The Consultant from and against any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by The Consultant. This includes but is not limited to data loss or lack of function in any component or element of the Client’s computer system and/or peripherals as a result of The Consultant’s actions or the actions of its agents, partners, and/or third-party service providers. All services shall be guaranteed for thirty (30) days, however if the issue resurfaces and is discovered by The Consultant to have been caused by negligence or misuse on behalf or the customer or other third party, The Consultant shall not be held responsible, and the foregoing guaranty will be nullified. You agree that The Consultant’s total liability for damages related to its provision of services is limited to the total amount you pay for such services, and you release The Consultant from liability for any indirect, incidental, special, or consequential damages. THE CONSULTANT IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR FOR THE CLIENT’S INABILITY TO USE THE CLIENT’S COMPUTER EQUIPMENT OR OTHER PRODUCT.

Discount coupons: From 1999 to 2006 CanadaRAM issued “Smiley” coupons for a $10 discount on RAM orders over $100 pretax. These coupons were discontiued in 2006 and the oldest coupons are now over 14 years old. Due to the declining prices on RAM, CanadaRAM will not accept any further Smiley discount coupons after October 15, 2011
